WHAT IS RESPITE?
It is non-medical care and supervision provided in the home of the individual served by the Regional Center and is intended to provide “Family Member(s)” a “break” or “rest”.
WHAT IS DAY CARE?
It is non-medical care and supervision provided during the hours that both “Family Members” are working; or for a single “Family Member”, while that person is working.
RESPITE AND/OR DAYCARE SERVICE-FAMILY MEMBER:
A Regional Center can classify an individual as a Respite Service and/or Day Care Service Family Member service provider if he/she is a “Family Member” (“Family Member” means an individual who has a developmentally disabled person residing with him or her, is responsible for the 24-hour care and supervision of the developmentally disabled person and is not a licensed or certified residential care facility or foster family home receiving funds from any public agency or regional center for the care and supervision provided), is not the direct provider of the respite and/or day care service, and selects the respite and/or day care service for the individual(s) served by the Regional Center from an individual:
● who is at least 18 years of age, and
● who possesses the skill, training or education necessary to provide the respite and/or day care service.
WHAT WILL BE MY RESPONSIBILITIES AS A RESPITE AND/OR DAY CARE SERVICE PROVIDER?
You will be responsible for ensuring that the individual selected to provide the respite and/or day care service will possess the skill, training, or education necessary to provide the service. In addition, you will be responsible for ensuring that the person providing the care is familiar with the daily routines and needs of the individual(s) served by the Regional Center, and is trained in any specialized supports necessary. To the extent that these specialized support needs require additional training or certification in such things as First Aid, Cardiopulmonary Resuscitation (CPR), etc., these needs and requirements will be included as part of the description of respite and/or day care needs in the Individual Program Plan (IPP) or Individualized Family Service Plan (IFSP) of the individual(s) served by the Regional Center.
CAN I HIRE MYSELF?
No. Title 17, California Code of Regulations, prohibits you from being the direct provider of the In-Home Respite and/or Day Care Services.
WHAT RECORDS WILL I NEED TO KEEP AND FOR HOW LONG?
You are required to keep the following financial and service records to support all billings for five (5) years from the date of final payment for the state fiscal year in which services were rendered:
● Photocopies of all Invoices from San Andreas Regional Center
● Photocopies of all Billing forms submitted to San Andreas Regional Center
HOW MUCH WILL I PAY MY RESPITE WORKER?
San Andreas Regional Center will reimburse you for authorized respite services up to $10.71 per hour, which includes fringe benefits. The fringe benefits are limited to: federal and state taxes, state disability insurance, social security, Medicare, unemployment insurance, employee training tax, life insurance, health insurance, dental insurance, vision insurance, retirement, and long-term disability insurance.
HOW MUCH WILL I PAY MY DAY CARE WORKER?
The rate in which San Andreas will reimburse you for day care services varies on an individual basis. Please speak with your Service Coordinator to discuss eligibility requirements.
WHAT IF I HAVE MORE THAN ONE FAMILY MEMBER ELIGIBLE FOR RESPITE AND\OR DAY CARE SERVICES?
San Andreas Regional Center has different rates depending on how many individuals served by the Regional Center are being cared for at the same time. Check with your Service Coordinator about the specifics that will apply to your family.
ARE SERVICE PROVIDERS EMPLOYEES OF AN ANDREAS REGIONAL CENTER?
No. As a service provider for Respite and/or Day Care Service-Family Member you will be an independent contractor, not an employee of San Andreas.
AS A VENDOR WILL I BE CONSIDERED AN EMPLOYER?
The government may consider you the respite and\or day care worker’s employer. You may be responsible for withholding federal, state, and local taxes from the respite worker’s wages and for paying and reporting the respite worker’s payroll taxes and wages to the IRS and the Employment Development Department (EDD). You may also have to provide workers’ compensation for the workers you hire. If you do not know how to do this, it is your responsibility to contact a tax consultant, IRS, EDD or a worker’s compensation carrier for more information.
HOW DOES THIS AFFECT MY GOVERNMENT BENEFITS?
If you are receiving SSI, social security benefits, veterans’ benefits or welfare, the money you receive for the services is exempt and will not affect your benefits, providing you pay it all to your employee(s). If your employee receives government benefits, the earned income you provide him/her may affect his/her benefits, and he/she will need to report the wages he/she receives from you.
HOW DOES THIS AFFECT MY PERSONAL TAXES?
San Andreas Regional Center cannot render tax or employment law advice. You should consult your personal attorney and/or tax advisor on these issues. There is information from the IRS, Franchise Tax Board, Social Security Administration, and Employment Development Department at the numbers listed in the government section of your phone book.
WILL MY INSURANCE BE AFFECTED BY MY BECOMING A SERVICE PROVIDER?
San Andreas Regional Center strongly recommends that you contact your insurance agent or broker to determine what effect becoming an in-home respite and/or day care service provider will have on your current coverage or what additional coverage you may need. San Andreas Regional Center carries no liability insurance covering any service provider including you, your employee(s), or the individual served by the Regional Center.
HOW DO I BECOME A SERVICE PROVIDER?
You must be referred to the above mentioned service(s) through your San Andreas Regional Center Service Coordinator. He/she will schedule you to attend a Parent Vendor Orientation where you will complete an application for either respite and\or day care services. Upon receipt of the completed forms, you will be assigned a Vendor Number. You will then be established as a Respite and\or Day Care Service Family Member service provider for your family member with a developmental disability..
HOW AND WHEN SHOULD I RECEIVE PRE-AUTHORIZATION FOR RESPITE AND/OR DAY CARE SERVICES ONCE I AM VENDORED?
Once you have been approved as a service provider, your family member’s Service Coordinator will complete an authorization. This form will be processed by San Andreas Regional Center and a copy mailed to you. The form states the time period you are authorized to utilize services, the number of hours of service you are authorized to utilize, and the rate of payment you will receive per hour for authorized service.
WHO CAN I EMPLOY AS A RESPITE AND/OR DAY CARE WORKER?
Respite and/or day care workers are solely your employees. You cannot provide the service and pay yourself. They must be at least 18 years of age and possess the skill, training, and education necessary to provide the service.
CAN THE RESPITE AND/OR DAY CARE WORKER I EMPLOY BE USED TO WATCH OTHER FAMILY MEMBERS THAT ARE NOT CONSUMERS OF SAN ANDREAS REGIONAL CENTER?
The rate authorized by San Andreas Regional Center is only for authorized services for the individual(s) served by the Regional Center living in your home. You may pay an additional amount for care of other family members, but it will not be reimbursed by San Andreas.
HOW DO I BILL SAN ANDREAS REGIONAL CENTER FOR RESPITE AND/OR DAY CARE SERVICES?
For each month you are authorized to utilize respite and/or day care services you must submit to San Andreas Regional Center a completed Billing Form and an Invoice (sent to you by San Andreas around the 23rd of each month).
HOW DOES SAN ANDREAS REGIONAL CENTER PAY FOR SERVICES?
San Andreas pays in arrears, usually within thirty (30) days of receipt of your billing/invoice. A billing/invoice received by the fifth (5th) working day of the month after the month of service should be paid on or about the fifteenth (15th) of that month. If the Billing Form and/or Invoice is incomplete payment will be delayed until all required billing information is obtained from you.
By law, San Andreas cannot pay for services in excess of those authorized or services provided prior to vendorization.
